Law and Society

The benefit of studying law as a social science is understanding how law and society work together and effect each other. When asking the benefit of studying law as a social science, it is important to first define what law and society are. Law is a system of rules that reflect the values of a society. Law consists of legal rules, written in a Constitution. The Constitution of a legal system is the rules/guidelines that governs a society. Society is a grouping of people who share a similar culture, who are governed under the same laws, have the same limits of liberties and live together typically in a geographical area.
Society is the people, that follow the laws, that are the guidelines to living life. When looking at law as a social science, the benefit is understanding how law and society coexist. It is also understanding why people obey the law and understand it. An example of this is looking at this is underaged drinking. Many teenagers drink underaged because it a normal thing with our society. Even though they are breaking the law, it is seen as normal. This is an example of a law that does not really effect or change society. An example of a law that is followed within society and helps shape is it, is the law against stealing. If stealing was allowed, no one would have a law protecting their personal items, fighting could result to the lack of this law. Most people obey this law, unlike underage drinking that is not enforced heavily, if one is caught stealing they are punished.
In looking at why we break and follow laws within a society is beneficial because it reflects the values that society holds. Another benefit of studying law as a social science is understanding how laws affect and shape society. How laws affect people's everyday life and change their values based on what is legal and what is illegal. In looking at how people (society) and law interact in daily life is beneficial to understanding the developing and changing values within a society. An example of this is the legalization of marijuana. The intake of marijuana has become more occurring and because of these new values of society, effects the law by making it legal in Canada in 2016. In looking at law as a social science, it is easier to understand how trends and new social values affect the development of law, the idea of the living tree.
In looking at law as a social science, it is beneficial to understanding why we obey laws and why we don't. Also, we are able to better understand why certain laws change and/or are created. By looking at law as a social science we can see how law and society coexist and affect each other. How law develops with society, as seen in the theory of the living tree.
